Kenya hospital imprisons new mothers with no money


NAIROBI, Kenya (AP) — The director of the Pumwani Maternity Hospital, located in a hardscrabble neighborhood of downtown Nairobi, freely acknowledges what he's accused of: detaining mothers who can't pay their bills. Lazarus Omondi says it's the only way he can keep his medical center running.


Two mothers who live in a mud-wall and tin-roof slum a short walk from the maternity hospital, which is affiliated with the Nairobi City Council, told The Associated Press that Pumwani wouldn't let them leave after delivering their babies. The bills the mothers couldn't afford were $60 and $160. Guards would beat mothers with sticks who tried to leave without paying, one of the women said.


Now, a New York-based group has filed a lawsuit on the women's behalf in hopes of forcing Pumwani to stop the practice, a practice Omondi is candid about.


"We hold you and squeeze you until we get what we can get. We must be self-sufficient," Omondi said in an interview in his hospital office. "The hospital must get money to pay electricity, to pay water. We must pay our doctors and our workers."


"They stay there until they pay. They must pay," he said of the 350 mothers who give birth each week on average. "If you don't pay the hospital will collapse."


The Center for Reproductive Rights, which filed the suit this month in the High Court of Kenya, says detaining women for not paying is illegal. Pumwani is associated with the Nairobi City Council, one reason it might be able to get away with such practices, and the patients are among Nairobi's poorest with hardly anyone to stand up for them.


Maimouna Awuor was an impoverished mother of four when she was to give birth to her fifth in October 2010. Like many who live in Nairobi's slums, Awuor performs odd jobs in the hopes of earning enough money to feed her kids that day. Awuor, who is named in the lawsuit, says she had saved $12 and hoped to go to a lower-cost clinic but was turned away and sent to Pumwani. After giving birth, she couldn't pay the $60 bill, and was held with what she believes was about 60 other women and their infants.


"We were sleeping three to a bed, sometimes four," she said. "They abuse you, they call you names," she said of the hospital staff.


She said saw some women tried to flee but they were beaten by the guards and turned back. While her husband worked at a faraway refugee camp, Awuor's 9-year-old daughter took care of her siblings. A friend helped feed them, she said, while the children stayed in the family's 50-square-foot shack, where rent is $18 a month. She says she was released after 20 days after Nairobi's mayor paid her bill. Politicians in Kenya in general are expected to give out money and get a budget to do so.


A second mother named in the lawsuit, Margaret Anyoso, says she was locked up in Pumwani for six days in 2010 because she could not pay her $160 bill. Her pregnancy was complicated by a punctured bladder and heavy bleeding.


"I did not see my child until the sixth day after the surgery. The hospital staff were keeping her away from me and it was only when I caused a scene that they brought her to me," said Anyoso, a vegetable seller and a single mother with five children who makes $5 on a good day.


Anyoso said she didn't have clothes for her child so she wrapped her in a blood-stained blouse. She was released after relatives paid the bill.


One woman says she was detained for nine months and was released only after going on a hunger strike. The Center for Reproductive Rights says other hospitals also detain non-paying patients.


Judy Okal, the acting Africa director for the Center for Reproductive Rights, said her group filed the lawsuit so all Kenyan women, regardless of socio-economic status, are able to receive health care without fear of imprisonment. The hospital, the attorney general, the City Council of Nairobi and two government ministries are named in the suit.

Bolivia Reduces Coca Plantings by Licensing Growers

TODOS SANTOS, Bolivia — There is nothing clandestine about Julián Rojas’s coca plot, which is tucked deep within acres of banana groves. It has been mapped with satellite imagery, cataloged in a government database, cross-referenced with his personal information and checked and rechecked by the local coca growers’ union. The same goes for the plots worked by Mr. Rojas’s neighbors and thousands of other farmers in this torrid region east of the Andes who are licensed by the Bolivian government to grow coca, the plant used to make cocaine.




President Evo Morales, who first came to prominence as a leader of coca growers, kicked out the Drug Enforcement Administration in 2009. That ouster, together with events like the arrest last year of the former head of the Bolivian anti-narcotics police on trafficking charges, led Washington to conclude that Bolivia was not meeting its global obligations to fight narcotics.


But despite the rift with the United States, Bolivia, the world’s third-largest cocaine producer, has advanced its own unorthodox approach toward controlling the growing of coca, which veers markedly from the wider war on drugs and includes high-tech monitoring of thousands of legal coca patches intended to produce coca leaf for traditional uses.


To the surprise of many, this experiment has now led to a significant drop in coca plantings in Mr. Morales’s Bolivia, an accomplishment that has largely occurred without the murders and other violence that have become the bloody byproduct of American-led measures to control trafficking in Colombia, Mexico and other parts of the region.


Yet there are also worrisome signs that such gains are being undercut as traffickers use more efficient methods to produce cocaine and outmaneuver Bolivian law enforcement to keep drugs flowing out of the country.


In one key sign of progress in Bolivia’s approach toward coca, the total acres planted with coca dropped 12 to 13 percent last year, according to separate reports by the United Nations Office on Drugs and Crime and the White House Office of National Drug Control Policy. At the same time, the Bolivian government stepped up efforts to rip out unauthorized coca plantings and reported an increase in seizures of cocaine and cocaine base.


“It’s fascinating to look at a country that kicked out the United States ambassador and the D.E.A., and the expectation on the part of the United States is that drug war efforts would fall apart,” said Kathryn Ledebur, director of the Andean Information Network, a Bolivian research group. Instead, she said, Bolivia’s approach is “showing results.”


Still, there is skepticism. “Our perspective is they’ve made real advances, and they’re a long way from where we’d like to see them,” said Larry Memmott, chargé d’affaires of the American Embassy in La Paz. “In terms of law enforcement, a lot remains to be done.”


Although Bolivia outlaws cocaine, it permits the growing of coca for traditional uses. Bolivians chew coca leaf as a mild stimulant and use it as a medicine, as a tea and, particularly among the majority indigenous population, in religious rituals.


On a recent afternoon, Mr. Rojas placed a few dried leaves into his mouth and watched the sun set over his coca field, slightly less than two-fifths of an acre, the maximum allowed per farmer here in this region, known as the Chapare.


“This is a way to keep it under control,” he said, spitting a stream of green juice. “Everyone should have the same amount.”


Mr. Rojas is a face of a changing region. He makes far more money growing bananas for export on about 74 acres than he does growing coca. But he has no intention of giving up his tiny coca plot. “What happens if a disease attacks the bananas?” he asked. “Then we still have the coca to save us.”


The Bolivian government has persuaded growers that by limiting the amount of plantings, coca prices will remain high. And it has largely focused eradication efforts, of the kind that once spurred strong popular resistance, outside the areas controlled by growers’ unions, like in national parks.


The registration of thousands of Chapare growers, completed this year, is part of an enforcement system that relies on growers to police one another. If registered growers are found to have plantings above the maximum allowed, soldiers are called in to remove the excess. If growers violate the limit a second time, their entire crop is cut down and they lose the right to grow coca.


Growers’ unions can also be punished if there are multiple violations among their members.


“We have to be constantly vigilant,” said Nelson Sejas, a Chapare grower who was part of a team that checked coca plots to make sure they did not exceed the limit.


But there is still plenty of cheating. Officials say they are going over the registry of about 43,000 Chapare growers to find those who may have multiple plots or who may violate other rules.

Analysis: For tech investors, it’s hard to know when to bolt






(Reuters) – When Hewlett-Packard Co agreed to buy British software company Autonomy in August last year for $ 11.1 billion, two well-known investors made diametrically different bets on how the big deal would play out.


To short seller Jim Chanos, who had been raising red flags on Autonomy for years and had started shorting shares of HP in 2011, the deal was another nail in the coffin of the Silicon Valley tech giant, according to a source familiar with his thinking.






But to activist investor Ralph Whitworth, co-founder of Relational Investors LLC, it was time to commit to HP and the turnaround story the company was trying to sell to Wall Street. His fund bought more than 17.5 million HP shares after the deal was announced, and Whitworth received a seat on the company’s board. This year, Relational roughly doubled its stake in HP.


In the wake of HP’s decision to take an $ 8.8 billion write-down on the deal because of alleged accounting irregularities at Autonomy, it appears Chanos – whose call to short Enron before the energy company collapsed in a corporate scandal may be his most famous trade – was more astute.


HP’s shares are down 36 percent since Relational, which declined to comment, built its stake in the third quarter of 2011.


BARRIERS TO ENTRY


Relational’s big move into HP is a reminder that even smart investors can get things wrong in the fast-evolving technology sector, where once hot global names like Research in Motion and Yahoo can quickly become yesterday’s news.


It is a world where a company may effectively erect barriers to entry in a market only to have them torn down by a rival with a new whizz-bang product – just as Apple‘s iPhone broke the dominance that Research in Motion’s BlackBerry had enjoyed.


One warning sign that a tech company may be on the verge of losing its edge is when it makes acquisitions outside of its main area of expertise to move into new product lines. Savvy tech investors also say be wary of companies that experience a succession of management changes, or when a successful core business starts looking tired.


The pace of change in the technology sector is much faster than in other industries, said Kaushik Roy, an analyst at Hercules Technology Growth Capital. “It attracts new talent and capital, many startups are formed, which can be extremely disruptive to incumbents,” Roy said. “In other words, yesterday’s winners can rapidly become today’s losers and vice versa.”


In the case of HP, the company not only has had four CEOs since 1999, it has been striving to find another niche to dominate as demand for one of its core products – computer printers – wanes and as its PC business stumbles.


Or consider online search pioneer Yahoo, which has gone through six chief executives and is struggling to keep pace with Google.


Josh Spencer, a portfolio manager at T. Rowe Price, said frequent turnover in the executive suite at Yahoo was a warning sign to him. Spencer said he does not own Yahoo shares and has not in the recent past.


RED FLAGS


While a company may view an acquisition as a fresh start – that is what HP was trying to say about Autonomy – some investors see it as a warning the core business is struggling.


Spencer noted that the technology industry’s most successful companies – Apple and Samsung – generally have not made acquisitions and instead developed new products internally.


For Margaret Patel, managing director at Wells Capital Management, one of the first red flags she saw at HP was when former CEO Carly Fiorina bought Compaq for roughly $ 25 billion in 2002.


“I felt then that the acquisition was too large and expensive, and personal computers were not their core strength,” said Patel, who has since avoided investing in HP.


Of course, timing can be everything even if an investor is eventually proven right. Patel missed out on a 137 percent gain in HP’s stock price from the time of the Compaq deal up until the end of 2010.


PREMIUM VALUATIONS


A few money managers see a flashing yellow light in the big sell-off of Apple shares in the past few months.


Apple, the most valuable U.S. company, has shed nearly 30 percent of its value in the last three months.


Since the death of co-founder Steve Jobs – the driving force behind Apple’s iPod, iPhone and iPad – DoubleLine co-founder Jeffrey Gundlach has been recommending that investors short the company’s shares because “the product innovator isn’t there anymore.”


Gundlach said he began shorting Apple’s stock at around $ 610 and maintains that it could drop to $ 425. He declined to comment on Tim Cook, who succeeded Jobs over a year ago and is seen by many as less visionary and innovative than Jobs.


Christian Bertelsen, chief investment officer at Global Financial Private Capital, with assets under management of $ 1.7 billion, said his firm began paring back its exposure to Apple this fall because he felt the expectations for the company’s new iPhone5 had gotten overheated.


He said his firm dramatically took down its exposure to Apple shares when the stock hit $ 670 a share. “For us, the light bulb went off this fall,” he said. Mind you, Apple’s shares still remain up about 25 percent for the whole year.


And then there’s Research in Motion. Once a leader in smartphones, it’s now in danger of becoming irrelevant.


“They saw the move towards all touch-screen phones and didn’t move with it,” said Stuart Jeffrey, an analyst at Nomura Securities who noted how the BlackBerry 10 touch-screen phone will debut on January 30, 2013, six years after Apple released its first iPhone in 2007.


Robert Stimpson, a portfolio manager at Oak Associates Funds whose fund does not own any shares of Research in Motion, said the company’s BlackBerry phones are on a downward slope and it will be tough for the company to regain its lost luster.


“The end of the road is a long, lonely journey,” Stimpson said of Research in Motion. “I think they will fight the good fight for many years, probably unsuccessfully.”

Gen. Norman Schwarzkopf, Commander in Persian Gulf War, Dies at 78

H. Norman Schwarzkopf, the Army general who commanded coalition forces in the Persian Gulf War against Saddam Hussein, died Thursday in Tampa, Fla., at age 78.

The cause of death was not immediately known. His death was confirmed to the Associated Press by a source.

Known as "Stormin' Norman" for his volcanic temper, the decorated Vietnam War combat soldier became a familiar face from his many press conferences during Operation Desert Storm in 1991.

Under his leadership during the presidency of George H.W. Bush, coalition forces drove Hussein's troops out of Kuwait, which Iraq had invaded, with relatively few coalition casualties, but the Iraqi leader remained in power.

Hussein would ultimately be left for Bush's presidential son, George W. Bush, to contend with.

After the Gulf War, Schwarzkopf became a television military analyst and went into a quiet retirement in Florida to write his memoirs.

The elder Bush, now hospitalized in intensive care, said in a statement that Schwarzkopf was a "true American patriot and one of the great military leaders of his generation."

"More than that, he was a good and decent man – and a dear friend," says Bush. "Barbara and I send our condolences to his wife Brenda and his wonderful family."

The true pulse of L.A.? It emanates from this oddly shaped heart









Samuel Krueger likes Los Angeles. A lot. Which is noteworthy because he grew up in Portland, Ore., where the word "Californication" was coined to describe L.A.'s baleful influence.


Portland has a well-defined urban core, while Dorothy Parker's description of L.A. — 72 suburbs in search of a city — has stuck with us, for good reason. Krueger, however, says L.A. and Portland have the same energy. And now he's discovered from where it springs: L.A. has an urban center after all.


Krueger, 29, works in geographic information systems for the Los Angeles Department of Water and Power. He is tall, bearded and resembles both a Pacific Northwest mountain man and an academic. His find came in an award-winning masters' thesis in geography studies at USC.





Krueger used an algorithm to map concentrations of overlapping urban features like high-end retail shopping, restaurants, nightclubs, theaters and museums. These clusters of "urban amenities," he said, comprise Los Angeles' urban center. Krueger named this core the "Santa Monica/Wilshire Corridor," after the main arteries that run through it.


"City center" is perhaps a misnomer for Krueger's core. His corridor crosses city boundaries. It's really long and shaped somewhat like a crab. It runs along the base of the Santa Monica Mountains from the beach to downtown. Hollywood, West Hollywood, Westwood, Beverly Hills, Venice, Melrose Avenue, 3rd Street, Beverly Boulevard and Koreatown are all part of it.


It may not look like other city centers, Krueger acknowledged. But it functions like other city centers, the source of street life and urban vitality. It's defined by the same features as the center of "real" cities, like the Loop in Chicago and Manhattan in New York City, he said in his thesis.


"I don't want to say it's comparable to Manhattan or the Loop in any aesthetic sense; obviously it's not," he said. "Los Angeles has its own way of making a center."


Krueger's map captures something real and true about Los Angeles. It encompasses the parts of the city where buzz begins and public life flourishes. It's the L.A. that matters.


But I couldn't quite get my head around the logic he used to come up with the boundaries. Krueger agreed to meet me at Umami Burger in Santa Monica so he could show me what he was talking about.


The joint was jumping. Across from us, a young mother, with the help of two nannies, struggled to keep her little noise-makers in check. Dudes drank beer and peered into their smartphones, reading text messages.


The thriving Umami burger chain could be a metaphor for Krueger's corridor: it started in mid-Wilshire, spread to Los Feliz and downtown and landed in Santa Monica, inside the trendy retail emporium Fred Segal.


After dinner, we walked to 4th Street, where Krueger pointed out Magicopolis, a magic shop that also does live theater. Nearby was a juice bar, a cafe and full-service restaurants.


"There's also a lot of hotels around here," Krueger said. "The whole point of my thesis is you might have a cluster of coffee shops, but that is not an urban cluster. It's when lots of different kinds of places are all


occurring in the same vicinity."


On the Third Street Promenade, a break dance troupe was performing. The troupe leader, "Thrill," pulled Krueger into the center of the circle of onlookers and tried to embarrass him into emptying his pockets. Thrill, an African American, addressed Krueger exclusively as "tall white man."


"That was interesting," Krueger said afterward, apparently undaunted. We passed a 71-year-old dancer in gauzy veils performing under the name "Scheherazade."


"A lot of people who say Los Angeles has no street life must not be visiting the parts of town I'm visiting," said Krueger, who lives in Hollywood.


The Santa Monica Pier was full of families, tweens and teens and strolling lovers. It draws people from all over the city, Krueger said.


"You may not have come here in 5 or 10 years," Krueger said. "But everybody comes here sometimes."


At the tip of the pier, we paused to watch the moonlight shimmer on the water.

CHENGDU, China — One day last summer, Pu Xiaolan was halfway through a shift inspecting iPad cases when she received a beige wooden chair with white stripes and a high, sturdy back.




At first, Ms. Pu wondered if someone had made a mistake. But when her bosses walked by, they just nodded curtly. So Ms. Pu gently sat down and leaned back. Her body relaxed.


The rumors were true.


When Ms. Pu was hired at this Foxconn plant a year earlier, she received a short, green plastic stool that left her unsupported back so sore that she could barely sleep at night. Eventually, she was promoted to a wooden chair, but the backrest was much too small to lean against. The managers of this 164,000-employee factory, she surmised, believed that comfort encouraged sloth.


But in March, unbeknown to Ms. Pu, a critical meeting had occurred between Foxconn’s top executives and a high-ranking Apple official. The companies had committed themselves to a series of wide-ranging reforms. Foxconn, China’s largest private employer, pledged to sharply curtail workers’ hours and significantly increase wages — reforms that, if fully carried out next year as planned, could create a ripple effect that benefits tens of millions of workers across the electronics industry, employment experts say.


Other reforms were more personal. Protective foam sprouted on low stairwell ceilings inside factories. Automatic shut-off devices appeared on whirring machines. Ms. Pu got her chair. This autumn, she even heard that some workers had received cushioned seats.


The changes also extend to California, where Apple is based. Apple, the electronics industry’s behemoth, in the last year has tripled its corporate social responsibility staff, has re-evaluated how it works with manufacturers, has asked competitors to help curb excessive overtime in China and has reached out to advocacy groups it once rebuffed.


Executives at companies like Hewlett-Packard and Intel say those shifts have convinced many electronics companies that they must also overhaul how they interact with foreign plants and workers — often at a cost to their bottom lines, though, analysts say, probably not so much as to affect consumer prices. As Apple and Foxconn became fodder for “Saturday Night Live” and questions during presidential debates, device designers and manufacturers concluded the industry’s reputation was at risk.


“The days of easy globalization are done,” said an Apple executive who, like many people interviewed for this article, requested anonymity because of confidentiality agreements. “We know that we have to get into the muck now.”


Even with these reforms, chronic problems remain. Many laborers still work illegal overtime and some employees’ safety remains at risk, according to interviews and reports published by advocacy organizations.


But the shifts under way in China may prove as transformative to global manufacturing as the iPhone was to consumer technology, say officials at over a dozen electronics companies, worker advocates and even longtime factory critics.


“This is on the front burner for everyone now,” said Gary Niekerk, a director of corporate social responsibility at Intel, which manufactures semiconductors in China. No one inside Intel “wants to end up in a factory that treats people badly, that ends up on the front page.”


The durability of many transformations, however, depends on where Apple, Foxconn and overseas workers go from here. Interviews with more than 70 Foxconn employees in multiple cities indicate a shift among the people on iPad and iPhone assembly lines. The once-anonymous millions assembling the world’s devices are drawing lessons from the changes occurring around them.


As summer turned to autumn and then winter, Ms. Pu began to sign up for Foxconn’s newly offered courses in knitting and sketching. At 25 and unmarried, she already felt old. But she decided that she should view her high-backed chair as a sign. China’s migrant workers are, in a sense, the nation’s boldest risk-takers, transforming entire industries by leaving their villages for far-off factories to power a manufacturing engine that spans the globe.


Ms. Pu had always felt brave, and as this year progressed and conditions inside her factory improved, she became convinced that a better life was within reach. Her parents had told her that she was free to choose any husband, as long as he was from Sichuan. Then she found someone who seemed ideal, except that he came from another province.


Reclining in her new seat, she decided to ignore her family’s demands, she said. The couple are seeing each other.


“There was a change this year,” she said. “I’m realizing my value.”

“This is a disgrace!” shouted Terry Gou, founder and chairman of Foxconn, the world’s largest electronics manufacturer and Apple’s most important industrial partner.

The Chinese version of Nokia’s (NOK) new flagship Windows Phone model recently debuted in Shanghai. According to pictures posted to Chinese websites, the Lumia 920T drew a big crowd… and sold out in two hours. So the debate over whether there is wide mass market demand for the model rages on.

The very limited early supply makes it hard to gauge the demand in China. The Lumia 920 did hit Amazon China’s (AMZN) top-five list a week ago, but sold out quickly and dropped out. There are now rumors about China Mobile planning to further subsidize the Lumia 920T in January, making it effectively free on contract. This would be China Mobile’s revenge on Apple (AAPL) for its refusal to cut a sweetheart deal with the giant carrier and its 700 million subscribers.

Nokia may thus be close to landing the Chinese version of the role that Motorola played for Verizon (VZ) in 2010. Back then, the U.S. carrier used DROID models to flaunt the fact that it did not really need the iPhone as badly as many assumed.


China Mobile is now planning to show Apple it can turn even Windows Phones into mass-market hits in China with its marketing and subsidy machine. This could be great for Nokia — if Apple isn’t forced into a cutting a quick deal in coming months. The iPhone’s ho-hum market share performance in markets like Latin America and Asia is piling pressure on Apple right about now.


In a fascinating U.S. twist, the Lumia 920 climbed the Amazon charts again over the past week as its supply has improved. The black variant of the Lumia 920 debuted in the top-three in November, dropped out of top-40 after Amazon’s delivery time stretched to two weeks… and has now staged a comeback to No.14. This makes it the second-biggest AT&T (T) phone on Amazon right now, with only the blue version of the Galaxy S III outperforming the 920.


The Lumia 822 is fizzling badly at Verizon, but Nokia just might be gaining a toehold at AT&T even after the pre-Christmas supply drama. It is now clear that the Lumia 920 is beating its biggest Windows rival, the HTC Windows Phone 8X, convincingly at AT&T.


This sets up a very interesting rivalry when AT&T debuts the new generation of BlackBerry 10 models sometime in February or March. The battle for the third mobile ecosystem at AT&T will be effectively waged by Nokia and RIM (RIMM) this spring. The loser may well find out that it does not have strong subsidy or marketing support in 2013.


AT&T has an incentive to build up a third rival for the Apple and Android ecosystems, but it has little reason to support both minor operating systems.

Kate Winslet has tied the knot with Richard Branson's nephew, Ned Rocknroll, her rep tells PEOPLE.

"I can confirm that Kate Winslet married Ned Rock'nRoll in NY earlier this month in a private ceremony attended by her two children and a very few friends and family," the rep says. "The couple had been engaged since the summer."

According to British media reports, Leonardo DiCaprio gave away the bride in a ceremony so secret that the bride and groom's parents didn't know about it.

The Oscar-, Golden Globe- and Emmy-winning actress, 37, has been dating Rocknroll, 34, (his legal name) since fall of 2011.

In August 2011, she and Rocknroll were on the same Caribbean island owned by Branson when a fire broke out and Winslet rescued Branson's 90-year-old mother.

Winslet previously was married to Sam Mendes and Jim Threapleton.
